Terms of use
By creating a ChannelCast account or using the service, you agree to these terms. If you are signing up on behalf of an organization, you confirm that you have the authority to bind that organization to these terms.
1. The service
ChannelCast provides a hosted broadcast and on-demand video platform — live ingest, transcoding, recording, scheduled programming, embeddable players, OTT feeds, and activation codes for connected-TV devices. The features available to your tenant depend on the plan you select.
2. Your responsibilities
- You are responsible for the content you ingest, archive, and distribute through the platform. You represent that you own or have licensed the rights to broadcast and store every asset on your tenant.
- You will not use the service to distribute content that is unlawful, defamatory, infringing, or violates the rights of any third party.
- You will keep your operator credentials secret. Activity performed under your account is your responsibility.
- You will not attempt to disrupt, reverse-engineer, or probe the platform for security weaknesses outside of an authorized testing engagement.
3. Plans, billing, and trials
Plans, prices, and included usage limits are listed on the pricing page and are governed by the billing policy. A 14-day free trial of the Pro tier is offered to new tenants and does not require a credit card. Paid plans are billed in advance and automatically renew unless cancelled before the renewal date.
4. Acceptable use
ChannelCast is a general-purpose broadcast platform. We reserve the right to suspend accounts that use the platform to distribute spam, malware, sexually explicit content involving minors, or content that violates the law of the jurisdiction in which the broadcast originates. Tenants on the Complete plan with multi-stage events should coordinate large surges (>10,000 concurrent viewers) in advance.
5. Intellectual property
You retain all rights to the content you upload. You grant ChannelCast a limited license to host, transcode, and deliver that content for the purpose of operating the service on your behalf. ChannelCast and Gomez Innovations retain all rights to the platform itself, including the admin console, OTT widget, embed player, and feed generators.
6. Termination
Either party may terminate the service for convenience. We will give you 30 days' notice for non-renewal of an annual plan. You may cancel a monthly plan at any time from the admin console; you will retain access through the end of the paid period. After cancellation, tenant data is purged per the privacy policy.
7. Liability
To the maximum extent permitted by law, ChannelCast's aggregate liability for any claim arising out of these terms is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profits damages.
8. Warranty disclaimer
The service is provided "as is." We make no warranty that the service will be uninterrupted, error-free, or that any specific live event will deliver to every viewer. We commit to commercially-reasonable best efforts and publish status at status@channelcast.tv.
9. Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in San Francisco County.
